Terms of Use
1. Acceptance of the Terms
These Terms of Use (“Terms”) govern your use of the Lyana mobile application (the “Application”), operated by Anastasiia Izhboldina, Ukraine (“we,” “us,” or the “Developer”). By creating an account or using the Application, you agree to these Terms. If you do not agree, do not use the Application.
2. Description of the service
Lyana is a tool for managing small and medium-sized businesses. Its features may include customer records, staff schedules, service appointments, internal cash records, inventory, and staff remuneration calculations.
3. Eligibility and business authorization
The Application is intended for authorized business owners, administrators, specialists, and personnel. You represent that you have the legal capacity or appropriate authorization required under applicable law to accept these Terms and that you are authorized to act for the relevant business workspace.
4. Accounts
- You need an account to use the Application.
- You must provide accurate information and keep it reasonably up to date.
- You are responsible for maintaining the confidentiality of your credentials and for activity performed through your account.
- Notify us promptly if you suspect unauthorized access or another security incident involving your account.
- You may not share access in a manner that bypasses workspace roles or security controls.
5. Acceptable use
You agree not to:
- Attempt to gain unauthorized access to the Application, systems, or data of another user or business.
- Use the Application for unlawful, fraudulent, or harmful activity.
- Enter customer or personnel data without a lawful basis or required notice or consent.
- Upload content that is unlawful or infringes privacy, intellectual property, or other rights.
- Interfere with the security, integrity, availability, or normal operation of the Application.
- Reverse engineer or circumvent technical restrictions except where applicable law expressly permits it.
6. Business data and customer information
If you are a business owner or administrator, you are responsible for the lawfulness and accuracy of customer and personnel data entered into the Application, including providing privacy notices and obtaining consent where required by the law applicable to your business.
You and the relevant business retain rights in the data and content you enter. You authorize us and our service providers to host, transmit, back up, and otherwise technically process that content only as necessary to operate, secure, and support the Application.
7. Privacy
Our Privacy Policy explains how the Application processes personal data and forms part of the information governing your use of Lyana.
8. Price
The Application is currently provided free of charge. In the future, certain features or plans may become paid. Users will be informed in advance of applicable terms and prices in accordance with the rules of the distribution platform and applicable law. No paid feature will be imposed retroactively without notice.
9. Third-party services
The Application depends on third-party infrastructure, including Supabase and Google Firebase. Their services may be subject to separate terms and privacy policies. We are not responsible for outages or changes outside our reasonable control, but we will use reasonable efforts to operate and support the Application.
10. Changes to the Application
We may update, improve, modify, or discontinue parts of the Application. Where a change materially affects users’ rights or access, we will provide reasonable notice where practicable and required by law.
11. Suspension and account deletion
You may delete your account at any time through More → Delete Account. The effect of deletion depends on your workspace role and is described on the Account Deletion page and in the Privacy Policy.
We may restrict, suspend, or terminate access where reasonably necessary to address a material breach of these Terms, unlawful activity, a security risk, or a legal requirement. Where appropriate, we will provide notice and an opportunity to remedy the issue.
12. Disclaimers
The Application is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we do not guarantee uninterrupted or error-free operation. You are responsible for reviewing the accuracy of business, inventory, cash, and remuneration records and for maintaining any records your business is legally required to keep.
13. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect or consequential losses caused by user actions, unlawful or inaccurate data entered by a user, third-party service failures, or events outside our reasonable control. Nothing in these Terms excludes or limits liability or user rights that cannot legally be excluded or limited.
14. Changes to these Terms
We may update these Terms. We will update the effective date above and notify users in the Application of material changes where appropriate. Continued use after the updated Terms take effect constitutes acceptance to the extent permitted by applicable law.
15. Governing law
These Terms are governed by the laws of Ukraine, without limiting any mandatory rights or protections available to you under the law of your country of residence.
